{"id":14729,"date":"2024-01-04T21:35:29","date_gmt":"2024-01-04T18:35:29","guid":{"rendered":"https:\/\/turkelli.com\/wordpress\/?p=14729"},"modified":"2024-01-06T12:42:50","modified_gmt":"2024-01-06T09:42:50","slug":"yargi-dur-dedi","status":"publish","type":"post","link":"https:\/\/turkelli.com\/wordpress\/2024\/01\/04\/yargi-dur-dedi\/","title":{"rendered":"Yarg\u0131 DUR dedi."},"content":{"rendered":"\n<p><strong>Erdal Kurto\u011flu Park\u0131 ve eski BESST Otel arazisi i\u00e7in yarg\u0131 DUR dedi! 04.01.2024<\/strong><\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Trabzon B\u00fcy\u00fck \u015eehir Belediyesinin, Be\u015fikd\u00fcz\u00fc Erdal Kurto\u011flu Park\u0131 ve eski BESST Otel arazisi i\u00e7in haz\u0131rlad\u0131\u011f\u0131 &#8220;\u00f6zel imar plan\u0131&#8221;, Trabzon \u0130dare Mahkemesi taraf\u0131ndan iptal edildi.<br><br>Trabzon B\u00fcy\u00fck\u015fehir Belediyesi, daha \u00f6nce yine mahkeme karar\u0131yla hakim orta\u011f\u0131 yabanc\u0131lar olan bir \u015firkete sat\u0131\u015f\u0131 iptal edilen ancak halen Be\u015fikd\u00fcz\u00fc Belediyesi taraf\u0131ndan tapu devri al\u0131nmayan, Erdal Kurto\u011flu Park\u0131 ve BESST Otel arazisi i\u00e7in &#8220;\u00f6zel&#8221; denilebilecek bir imar plan\u0131 haz\u0131rlam\u0131\u015ft\u0131. \u00d6yle ki, planda BESST Oteli arazisi \u00fczerinde 23 katl\u0131, 80,5 metre y\u00fckseklikte bir otel rezidans in\u015faat\u0131 \u00f6ng\u00f6r\u00fcl\u00fcyordu.<\/p>\n\n\n\n<p>T\u00fcrkiye&#8217;nin farkl\u0131 yerlerinde ya\u015fayan Be\u015fikd\u00fcz\u00fc ve Trabzonlu olan \u00e7ok sy\u0131da insan TBB&#8217;ne bu imar plan\u0131 d\u00fczenlemesinin iptal edilmesi i\u00e7in dilek\u00e7e vermi\u015fti.<br><br>Be\u015fikd\u00fcz\u00fc&#8217;l\u00fc, \u00c7evre sorunlar\u0131na duyarl\u0131 bir grup insan, kamusal kullan\u0131m alanlar\u0131na yap\u0131lmak istenen bu tecav\u00fcze kar\u015f\u0131, Trabzon \u0130dare Mahkemesine dava a\u00e7arak, plan\u0131n iptalini istediler.<br><br>Mahkeme gerekli ke\u015fif, bilirki\u015fi raporlar\u0131, ilgili belediyenin savunmalar\u0131 gibi karara esas unsurlar\u0131 tamamlad\u0131ktan sonra, karar\u0131n\u0131 davac\u0131lar\u0131n talepleri do\u011frultusunda vererek, imar plan de\u011fi\u015fikli\u011fini iptal etti.<\/p>\n\n\n\n<p>TBB, itiraz hakk\u0131n\u0131 kullanacak m\u0131?
